<p>Oh Verizon, did you just spill confidential information all over your YouTube channel? The guys over at <em>Droid-Life</em> spotted a VZW ad starring a mysterious new Honeycomb tablet, which to our ninja-trained eyes looks to exhibit many of the design elements of Motorola&#8217;s Xoom. It could, of course, be just about anything, given that Verizon yanked the video almost as soon as the above screengrab was lifted, but the rear of this 10(ish)-inch tablet looks very much like a Xoom designed to be used in portrait orientation. We know Moto has a Xoom 2 cooking in the oven and it&#8217;s not unreasonable to surmise that Verizon is putting together the finishing touches on a promo campaign for it. Now if only we could get a look at that video with our own eyes&#8230;

			<content:encoded><![CDATA[<p>Here&#8217;s a phrase PayPal might want to keep in mind as it wages a civil battle against two former executives who defected to Google: Location, location, location.</p>
<p>Because when it comes to employment breach of contract and trade-secret cases, California can be a much pricklier state for a spurned employer to prevail within than many others.</p>
<p>&#8220;California law is very hostile to these types of suits,&#8221; said Jason Shultz, acting director of the Samuelson Law, Technology &amp; Public Policy Clinic at the UC Berkeley School of Law, &#8220;I&#8217;d say over at PayPal, they have a little bit of uphill battle.&#8221;</p>
<p>While much of PayPal&#8217;s allegations against Stephanie Tilenius and Osama Bedier revolve around alleged  breach of employment contract and non-compete violations, provisions within the California Business and Professional Code actually limit the enforceability of non-compete disclosures that companies like Pay Pal make employees sign.</p>
<p>The result &#8212; regardless of whatever contracts an employer forces a worker to sign when they start a job &#8212;  is that contracts often fall apart when they get in front of a judge.</p>
<p>&#8220;California is very pro-competition, especially here in the Silicon Valley. Think of startup culture. We like to entice employees to jump ship and compete with former employers,&#8221; Shultz said. &#8220;This state has a very free-trade approach to labor markets. You can&#8217;t lock in your employees forever. You have to compete to keep them.&#8221;</p>
<p>PayPal filed suit in Santa Clara County Thursday, accusing former employees Stephanie Tilenius and Osama Bedier, as well as Google, of misappropriation of trade secrets, breach of contract, and a host of other claims related to the recruitment of PayPal employees and the alleged improper use of PayPal’s confidential information.</p>
<p>Other aspects of PayPal&#8217;s claims could be held up to extra scrutiny in California as well. In its legal complaint, the company argues Bedier&#8217;s defection from PayPal&#8217;s mobile payments division to Google&#8217;s will result in the &#8221;inevitable disclosure&#8221; of unspecified proprietary trade secrets. It&#8217;s called the inevitable disclosure doctrine. &#8220;Essentially they are saying he&#8217;s the man who knows too much and can&#8217;t leave and work elsewhere,&#8221; Schulz said. &#8220;California has rejected that doctrine as well.&#8221;</p>

This points to Apple&#8217;s habit of tying up loose ends before an official release. The takedown reads:</p>

<p>We represent Apple Inc. (“Apple”).  It has come to our attention that the crunchgear.com website has posted Apple confidential trade secrets and copyrighted material in an article entitled &#8220;Preview: Snow Leopard (10A432)&#8221; located at http://www.crunchgear.com/2009/08/17/review-snow-leopard-10a432/.</p>
<p>While we appreciate the interest in Snow Leopard, the screenshots that have been posted in the article are confidential and subject to non-disclosure agreements between Apple and its developers. Dissemination of confidential information knowingly obtained or derived from someone in breach of non-disclosure obligations constitutes trade secret misappropriation. See, e.g., Cal. Civ. Code 3426.1(b)(2)(B)(iii).   Some of the screenshots also depict works copyrighted by Apple, and copyright law prohibits the unauthorized display of copyrighted works.

<p>We received a similar takedown when we posted pictures of <a href="http://redirectingat.com?id=21261X792902&xs=1&url=http%3A%2F%2Fwww.crunchgear.com%2F2007%2F09%2F05%2Fthe-ipod-fat-nano-fat-and-thin-and-fat-and-rad%2F&sref=rss">the real iPod Nano back in the day</a>. Therefore, we can only assume we&#8217;re working with an honest-to-Betsy real copy of Snow Leopard. </p>
<p>What does this mean? Not much. We do know that this release is nicely locked down and I haven&#8217;t had the same problems I experienced on earlier versions of the software. At least I know this version won&#8217;t blow up my Mac Pro.</p>
